FIRST. General Information
These legal terms and conditions govern access to and general use (hereinafter, the “Legal Terms and Conditions”) of the web-based software “EMERALD IMPACT” (hereinafter, the “Software”), which EMERALD IMPACT (hereinafter, “EMERALD IMPACT”) makes available to individuals who use the Software, register on it, and make use of its services (hereinafter, collectively “Users” or “Clients”, and individually “User” or “Client”), as well as the website emeraldimpact.es (hereinafter, the “Website”) through the authorised infrastructure of EMERALD IMPACT.
EMERALD IMPACT is the owner and holder of the Software, the Website, the brand, and all associated intellectual and industrial property rights, as well as all proprietary elements of the business operated by EMERALD IMPACT through the Website. EMERALD IMPACT’s registered address is Paseo San Francisco de Sales 41, Esc1 – 6A, 28003 – Madrid, and its Tax ID (CIF) number is B10786176. In compliance with the provisions of the Law on Information Society Services and Electronic Commerce, the following general information about this website is provided to Users/Clients:

SECOND. Purpose
The Software and/or Website have been created by EMERALD IMPACT to provide Users with a tool that facilitates access, through its web interface and/or software, to a wide range of services, including but not limited to: the management of rental and/or owned real estate properties; management of tenants interested in renting a property; verification and validation of identity and documents related to rental applications; creation and digital signing of tenancy agreements; incident management for properties; management of property-related services (water, electricity, gas, etc.); direct chat communication between landlords and tenants; access to a tenant scoring system (“scoring”) for property selection; portfolio grouping and management by real-estate agents and/or property management companies; publication of rental listings and contract-related management; payment of deposits to public entities; access to a shared database of problematic tenants; access to landlord and tenant reviews, and more.
Some of these services may be offered by various providers—mainly real-estate portals, agents, public administrations, landlords, or tenants (hereinafter, “Providers” or “Provider”)—the purpose of the Software being to serve as an intermediary between Users and such Providers by offering a management tool for real-estate assets, whether used by tenants, private landlords, independent professionals, or companies operating in the property sector.
Access to and use of the Software and/or Website necessarily imply full submission to, understanding of, and acceptance of the Legal Terms and Conditions contained herein and/or published at any time when the User accesses the Software and/or Website.
Any modification of these Terms and Conditions will be communicated to the User at the time of connection to the Software and/or Website, so that the User may review and accept such modifications.
These general contracting conditions shall become part of the agreement upon their acceptance, which shall be verified by clicking the corresponding button “I have read and accept the legal terms and conditions.” In the case of electronic contracting, both parties waive the conventional signature, which shall be replaced by the written confirmation of the concluded contract under the provisions of these General Terms of Contract.
The contract shall become effective and binding, and shall generate the obligation for the Company to provide the User/Client with access to the platform, as soon as payment is made under the agreed conditions. The gratuitous nature of some services offered by EMERALD IMPACT shall not, in any case, imply the inexistence or ineffectiveness of the contract and shall likewise entail full submission to these Terms and Conditions of Use.
THIRD. Registration
To use the Software and/or Website, Users must first register in a database owned by EMERALD IMPACT. Registration may be completed in the following ways: Users may sign up through automatic access using Google or Microsoft accounts or through manual data entry, in which case Users must provide, at minimum, their email address and access password. Upon completion of the registration process, Users will receive a unique identification code and password, both strictly personal and non-transferable, assigned solely and exclusively to that User, who will be responsible to EMERALD IMPACT and to third parties for proper use, non-transfer, and non-disclosure to any other natural or legal person.
EMERALD IMPACT reserves the right to reject any registration request whose content does not align with the purposes of the Software and/or Website.
FOURTH. Services
To access and purchase certain Services available through the Software and/or Website, Users must be at least eighteen (18) years of age and possess full legal capacity. Acceptance of this condition occurs upon registration or, where applicable, upon the use of data through the Website. Acquisition of specific Services through the Software and/or Website shall also imply the User’s declaration of legal age. Users may cancel or unsubscribe from acquired Services by providing at least thirty (30) days’ prior notice. However, certain Services may have different cancellation policies, which will be communicated within the relevant service description. In the absence of such communication, the thirty-day notice period shall apply.
Any payment made by the User through the Software and/or Website shall be directed to a bank account designated for this purpose and owned by EMERALD IMPACT. EMERALD IMPACT may also offer third-party or Provider services through the Software and/or Website that may be billed or paid directly to the respective third party’s designated account, in which case EMERALD IMPACT shall bear no responsibility for the transaction. EMERALD IMPACT undertakes to inform the User of such conditions in advance.
Any questions or claims regarding the purchase, cancellation, or acquisition process of Services through the Software and/or Website shall be submitted via email to info@emeraldimpact.es. EMERALD IMPACT commits to respond to the User or potential User within a maximum period of ten (10) business days.
The Company undertakes to provide the contracted Service under the following conditions:
The Company ensures that all data transfers carried out through its URLs will be performed via a Secure Server, ensuring that information is transmitted in encrypted form and inaccessible to any unauthorised party. Both parties expressly agree to retain all communications exchanged between them—whether through the Company’s URL or email—as proof of transactions performed.
The Company commits to maintaining continuous operation of the Service, except in cases of force majeure or circumstances beyond the control of EMERALD IMPACT. Specifically, and without limitation, these include failures, defects, or deficiencies in the server or data-transmission network. The Company may also interrupt its services for technical, security, and/or system-maintenance reasons, in which case Users will be notified at least twenty-four (24) hours in advance.
FIFTH. Duration of the Contract
The contract shall enter into force once the USER activates their profile and links, via the platform, a tenancy agreement or landlord profile, and shall remain in effect until the Client (i) no longer manages any property or landlord profile through the platform, or (ii) notifies cancellation at least thirty (30) days in advance.
SIXTH. Intellectual and Industrial Property
EMERALD IMPACT is the owner—or legitimate licensee—of all intellectual and industrial property rights to the Software and/or Website, as well as all elements contained therein, including but not limited to: texts, designs, images, audio, databases, structure, software programs and/or applications, graphic content of any kind, trademarks, logos, trade names, and distinctive signs. All rights are reserved. Any form of exploitation, including reproduction, distribution, transfer to third parties, public communication, or transformation—by any means or medium, in whole or in part—of the aforementioned works, creations, or distinctive signs without prior express authorisation from their respective owners is strictly prohibited. Violation of this prohibition may constitute an offence punishable under current legislation. Users may, however, download or make copies of such elements solely for personal use, provided they do not infringe EMERALD IMPACT’s intellectual or industrial property rights. In particular, Users may not alter, modify, or delete them, in whole or in part. Under no circumstances shall this imply authorisation or licensing of EMERALD IMPACT’s rights.
SEVENTH. Privacy Policy
In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (the “General Data Protection Regulation”, or GDPR), Users are informed that use of the Software and/or Website requires the communication of personal data. These data will be included in a file owned by EMERALD IMPACT, duly registered with the Spanish Data Protection Agency, for the purposes of identifying Users, providing access to the Software and/or Website, and sending commercial information and advertising about the Services offered.
By accepting these Legal Terms and Conditions, the User declares that all information and data provided are accurate, current, and truthful, and expressly consents to the communication of personal data to Providers in order to identify Users for the proper provision of Services and to inform them of updates or commercial promotions within the Provider’s legitimate business activity. Users may withdraw their consent or exercise their rights of cancellation, objection, or rectification at any time, by sending a written request to EMERALD IMPACT at Paseo San Francisco de Sales 41, Esc1 – 6A, 28003 – Madrid, or via email at info@emeraldimpact.es. In both cases, Users must attach a copy of their national ID, passport, or other valid identification document.
Users are also requested to notify EMERALD IMPACT of any changes to their data to ensure that our records remain accurate and up to date. EMERALD IMPACT shall not be responsible for third-party privacy policies related to personal data that Users may provide via links available in the Software and/or Website. EMERALD IMPACT assumes no responsibility for the content of third-party websites accessible through such links and shall not examine or exercise any control over such external content. Certain non-personal and non-identifiable information may be collected during live sessions to improve website management and facilitate User navigation; this information is not permanently stored on the User’s device. EMERALD IMPACT will always process your data in strict confidence, maintaining the duty of secrecy and adopting appropriate technical and organisational measures to ensure data security and prevent alteration, loss, unauthorised processing, or access, taking into account the state of technology, the nature of stored data, and the risks to which they are exposed.
EIGHTH. Automated Processing of Personal Data
I authorise the processing of my personal data under the terms set out below, acknowledging that acceptance of the contract constitutes authorisation for the processing necessary to provide the service.
The data we collect are as follows, without prejudice to our requesting additional information where necessary:
- If you are a tenant or prospective tenant: Full name, telephone, email, address, National ID/Foreign ID/Passport, bank account(s), net monthly income, employment start date, employment status, end date (if applicable), payslips, employment history. If self-employed: income tax return, tenant type (guarantor or tenant), and rent amount.
- If you are a property owner: Full name, telephone, email, address, National ID/Foreign ID/Passport, bank account, full property address (Country, Province, City, Postcode, Neighbourhood, District, Sector, Street, Number, Block, Stairway, Floor, Door), year of construction, usable area, built area, plot area, photographs, number of rooms, number of bathrooms, kitchen description, appliances, property type, utilities status, community fees, other expenses, occupancy certificate, energy certificate, property cadastral reference, parking/storage cadastral reference (if applicable), land registry extract/deed, monthly rent and contract duration, meter readings (water, electricity, gas), recent utility bills, last property tax (IBI) receipt, property inventory, electrical installation certificate (CIE) and, for properties in Catalonia, the Electrical Installations Recognition Certificate (BRIE).
- If you are a company or professional: Full name or business name, telephone, email, address, National ID/Foreign ID/Tax ID (CIF), bank account, professional registration number for property administrator or real-estate agent (API).
NINTH. Applicable Law and Jurisdiction
The provision of the Services under this Contract shall be governed by Spanish law. The Company and the Client, expressly waiving any other jurisdiction, submit to the Courts and Tribunals of Madrid for any disputes that may arise from the provision of the services covered by these General Conditions and the contract concluded between them.
